Terms of Service

These Terms govern your use of Apelles, the content strategy platform at apelles.app. By creating an account or using the service, you agree to be bound by these Terms and by our Privacy Policy.

If you are accessing Apelles on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

You are responsible for keeping your sign-in credentials safe, for activity under your account, and for ensuring that other members of your organization use Apelles in line with these Terms.

You retain all rights to brand assets, strategy material, imagery, and copy you upload to or generate within Apelles. You grant Apelles a non-exclusive licence to process that content as needed to operate the service — including passing relevant inputs to AI providers for generation tasks you initiate (see “AI-generated content” below).

A core feature of Apelles is producing marketing imagery and copy by AI models (currently Google Gemini, Anthropic Claude, and Nano Banana). You acknowledge that:

• Output is generated by machine systems and may contain inaccuracies, awkward phrasing, factual mistakes, or visual artefacts.
• Apelles makes no warranty that AI-generated content is fit for any particular purpose, free of bias, or compliant with platform-specific advertising rules.
• You are solely responsible for content you choose to publish or distribute. Apelles does not publish AI-generated content on your behalf without an explicit action from you.
• You should review AI output for factual accuracy, brand safety, copyright concerns, and regulatory compliance before publishing.

Apelles connects to platforms like Shopify, Canva, and Metricool when you choose to enable them. Your use of those platforms is governed by their own terms; Apelles is not responsible for changes to or outages of those services.

For Shopify specifically: Apelles reads product catalogue data only (read_products scope). We do not write to your store. If you uninstall Apelles from your Shopify store, the access token is revoked immediately and all imported product data is deleted within 48 hours per our Privacy Policy.

You agree not to use Apelles to:

• Generate content that infringes third-party intellectual property, including imagery that imitates protected brands, celebrities, or copyrighted characters without rights.
• Generate content that depicts minors in sexualized, dangerous, or exploitative ways.
• Generate or distribute content that incites hatred, harm, illegal activity, or deception (including AI-generated content presented as factual when it is not).
• Reverse-engineer the service or attempt to bypass scope, rate, or quota limits.
• Resell access to your Apelles account to third parties outside your organization.

We may suspend or terminate accounts that violate these rules, with notice where reasonable.

Apelles offers a free tier and paid tiers. Paid tiers are billed via Stripe; payment details never reach Apelles servers. Quotas and pricing for each tier are described on the pricing page.

We aim for high availability but do not guarantee uninterrupted service. Maintenance windows, third-party outages (Vercel, Supabase, Inngest, AI providers), and unforeseen issues may cause downtime. We do not provide service credits for the free tier.

To the extent permitted by law, Apelles is provided “as-is” without warranties beyond those expressly stated. Our aggregate liability for any claim is limited to the fees you paid us in the twelve months preceding the claim, or EUR 100 if you are on the free tier.

We may update these Terms from time to time. If a change is material we will notify account owners by email at least 14 days before the new Terms take effect. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. Disputes shall be resolved in the courts of Amsterdam.
